Managing Associate, Trademarks Prosecution, Oppositions & Enforcement

Position Overview
 

We are looking for a Managing Associate to join our Intellectual Property practice, covering both trademark prosecution and oppositions/enforcement work. This role is positioned between the Senior Associate and Principal Associate levels, and is for a lawyer who has developed solid technical expertise and is ready to take on greater ownership of client matters while progressively building the leadership, client management. The ideal candidate should have a strong law firm background, excellent drafting and advisory skills, and the ability to independently manage a wide range of trademark matters.

 

Roles & Responsibilities

  • Advising clients on trademark availability, registrability, risk assessment, enforcement strategies, and portfolio management across jurisdictions;

  • Providing strategic legal advice and guidance to clients on a broad range of intellectual property matters, including trademarks, copyrights, trade secrets, and related enforcement issues;

 

  • Managing end-to-end trademark prosecution matters, including filing strategy, specification drafting, responses to examination reports, and representation before the Trade Marks Registry at show-cause hearings;

  • Independently handling oppositions, cancellations, rectifications, and other contested proceedings, including drafting pleadings, evidence affidavits, written submissions, and related documentation and representation before the Trade Marks Registry for contested proceedings;

  • Monitoring, managing, and driving progress of matters before the Trade Marks Registry and other relevant authorities to ensure timely action and compliance;

  • Advising on and handling chain of title matters, assignments, recordals, renewals, and maintenance of large domestic and international trademark portfolios;

  • Coordinating and managing foreign trademark filings while maintaining strong working relationships with international associates and local counsel across multiple jurisdictions;

  • Negotiating and drafting consent letters, coexistence agreements, licence agreements, settlement agreements, and other commercial intellectual property-related documentation;

  • Advising on and coordinating enforcement actions, including cease-and-desist notices, online takedown actions, domain name disputes, and physical investigations relating to infringement and counterfeiting;

  • Handling copyright prosecution matters and related advisory work;

  • Managing proceedings before the Registrar of Companies and other regulatory authorities in relation to intellectual property rights;

  • Working closely with partners and clients on strategic IP protection and enforcement initiatives while independently managing day-to-day client communication and matter execution;

  • Mentoring junior team members, reviewing work product, and assisting in the overall management and development of the practice.
